GENERAL TERMS

• Customer hereby authorizes repair work to be done as described in the Quote/Work Order, or subsequent warranty work or change orders, with the necessary materials and labour to be charged at regular prices. Customer’s boat may be moved by MMS for purposes of testing, inspection or delivery at Customer’s sole risk.

• Customer agrees that MMS will not be held responsible for loss or damage to the boat or articles left in or on the boat in case of fire, theft, accidents or other causes beyond MMS control, and releases MMS from “care, custody, and control” upon being notified boat is ready for pickup or that the work has been completed. Customer further warrants that vessel is insured.

QUOTES AND PRICING

• All work performed by MMS is based on a quote/estimate written or verbal that has been approved by the customer. All estimates are subject to the accuracy of information provided by the customer. If the customer is aware of ANY issues at all he or she must inform MMS in writing about all of them prior a quote/estimate is issued or the work has commenced. If any additional problems are found by MMS the customer will be informed about them and the work will continue after a verbal or written approval. In some cases another estimate may not be possible to be issued. Such examples are boats and engines old or in poor condition where a failed component or system has caused consequent failures. When we perform repairs we always use skill and judgement to find the root cause of the problem and eliminate any future failures. In these cases, in order to complete the work and return the equipment to a functional state, we may have to use components and extra labour that was not included in the initial quote/estimate and the price of the work will be based on the time and materials used to complete the job.

WARRANTIES

• MMS warrants all repairs and installations for one year from date of invoice. Parts supplied by customer are not warranted. Parts supplied by MMS carry manufacturer's warranty. All MMS work is carried out with due care and skill and all the parts and materials supplied with the work are reasonably fit for the purpose and the work is checked by MMS technicians at the completion to ensure the work is at a satisfactory level. For the situations where the work cannot be verified at the completion (e.g. a water test for a repair that was conducted at customer premises) it is customer duty to test as soon as reasonably possible. Not using the boat/engine for a long period of time will not be accepted as an excuse, all the work should be verified by customer immediately after completion. Should a problem arise, or you are not completely satisfied with the quality of the work, contact MMS immediately. MMS reserves the right to perform any warranty repairs resulting from work previously billed by MMS at any time during the warranty period. MMS will not pay for warranty repair provided by third parties. Any work done by anyone other than MMS will void all warranties. Warranties are not transferable.

• Customer gives the consent to allow MMS to take and use photos of the vessel and work performed for the promotion of our business. We will never use the name of your vessel without your prior consent.

LABOR RATES

• 1 technician $165 per hour

CALL OUT FEES

Call out fee is calculated based on the time travel and charged @$165/hour and charged in increments of 30 minutes

For distances of over 50km to your location from our office you will be charged by the hour for the first 50km then $1.75 per kilometre after that. This cost also includes our return journey and any tolls we need to pay on route.

This price includes all tolls and charges associated with traveling to and from your job.

A call out fee is included on every job that a vehicle is dispatched to your premises.

Work will not commence unless the quote is approved.

PAYMENTS AND REFUNDS

• All invoices, including insurance claims are issued COD and MUST be paid in full upon completion work. There will be no exceptions. Invoices are due upon receipt and become past due 2 days after the date of invoice. After 2 days, credit card on file will be used to cover balance due, unless prior payment method has been arranged.

• An express possessory lien is granted on Customer’s equipment (boat, engine, gearbox and any other item subject to inspection, service or repair by MMS) to secure the amount of repairs thereto and released when outstanding balance is paid in full. If MMS is forced to take action for collection of any undisputed outstanding balance, Customer agrees to pay for all collection and/or attorney costs and fees. MMS reserves the right to charge parking fees (to cover the security of the vessel) at a rate of $2.5 per foot per day for every day after the work has been completed and customer was invoiced and informed that the equipment is ready to be picked up.

• All Work Orders over $1,000.00, or needing major material purchases, require a 100% on parts. For jobs lasting longer than one week, weekly progress payments will be required to cover expended costs.

• 5% of labor is added to each invoice for miscellaneous shop materials and supplies not scheduled and quoted prior to work.

If for any reason you are not completely satisfied with our service we will give you a 30 day money-back guarantee from the time the service was done. Please email us at [email protected] within that time if you are not satisfied so that we can resolve any problems.

This refund policy does not apply to jobs where:

- Any parts were supplied by the customer

- The boat/trailer/engine had issues in other areas than the work performed (e.g. If you have a problem call us before getting and online service quote as there may be additional costs for repair)

- The boat was not used correctly after the service/repair or the customer has not followed the instruction of use as stated in the user manual or as per MMS instructions
